By using BOOKMAX.NET, you agree to these Terms of Use. Please read them carefully.
These Terms of Use govern your use of the BOOKMAX.NET website and services. If you use BOOKMAX.NET as a consumer, nothing in these Terms limits or excludes any mandatory rights you have under applicable consumer protection law.
1. Bookmax.net service and acceptance of these terms
BOOKMAX.NET provides an online service that allows users to create, manage and store bookmarks, lists, addresses, notes, documents and other digital content.
These Terms of Use form an agreement between you ("you" or "User") and BOOKMAX.NET ("BOOKMAX.NET", "we", "us" or "our") and govern your use of the Service.
By creating an account or using the Service, you agree to these Terms of Use and our Privacy Policy.
If you do not agree to these Terms, you must not use the Service.
If you are a consumer, mandatory consumer protection provisions applicable to you remain unaffected by these Terms.
2. The Bookmax.net service
BOOKMAX.NET provides an online service through which you can create, manage and store bookmarks, lists, addresses, notes, documents and other digital content.
Certain basic functions may be available without charge. Additional storage and features may be available through a PREMIUM subscription.
The specific features, storage limits and prices applicable to your account are displayed on the BOOKMAX.NET website or during the purchase process.
You are responsible for having the necessary Internet connection and compatible equipment to access the Service. BOOKMAX.NET does not provide your Internet connection and is not responsible for fees charged by your Internet or telecommunications provider.
Your use of the Service is also subject to our Privacy Policy.
3. Your account and account security
You are responsible for maintaining the confidentiality of your login information and for activities carried out through your account, except where such activities result from circumstances for which BOOKMAX.NET is legally responsible.
You should choose an appropriate password and must not knowingly make your login information available to unauthorized persons.
If you lose access to your login information and BOOKMAX.NET has no reasonable technical or legal means of verifying your identity and restoring access, we may be unable to restore access to your account.
You are responsible for keeping the email address associated with your account up to date.
If an account is used on behalf of a company or other organization, the organization may determine how the account and its data are administered, subject to the agreement between the organization and the relevant user.
4. Your data
You retain your rights to the data and content that you store using BOOKMAX.NET.
BOOKMAX.NET does not claim ownership of your bookmarks, notes, documents or other content that you upload or create through the Service.
We process your data only to the extent necessary to provide, maintain, secure and improve the Service, comply with legal obligations, or otherwise as described in our Privacy Policy.
We may use technical service providers, hosting providers and other processors where necessary to operate the Service. Such processing is subject to applicable data protection law and our Privacy Policy.
BOOKMAX.NET does not generally monitor the content stored in your account. However, we may access or process data where reasonably necessary to:
- provide or maintain the Service;
- diagnose or resolve technical problems;
- investigate security incidents;
- comply with legal obligations or lawful requests;
- protect BOOKMAX.NET, its users or third parties; or
- enforce these Terms where reasonably necessary.
You remain responsible for ensuring that the content you store or share through the Service is lawful and does not infringe the rights of others.
You must not use BOOKMAX.NET to store or distribute content that is unlawful, fraudulent, malicious, defamatory, threatening, or that infringes intellectual property, privacy or other rights of third parties.
Nothing in these Terms prevents you from exercising rights granted to you by applicable data protection or consumer protection law.
4a. Public pages
What you keep in the private part of your account is your own business. BOOKMAX.NET does not review it, and the paragraph below does not apply to it.
A public page is different: it is published by BOOKMAX.NET and readable by anyone. You must not publish on a public page, and must not link from one to:
- pornographic or sexually explicit material, and anything involving minors in a sexual context;
- material that incites hatred or violence against a person or a group, in particular on the grounds of origin, religion, ethnicity, disability, gender or sexual orientation;
- material glorifying or promoting terrorism, extremism or violent crime;
- malware, phishing pages or fraudulent offers;
- material that infringes the copyright, trade mark, privacy or personality rights of others;
- content published solely to place links for search engine purposes rather than for readers.
BOOKMAX.NET may remove such content, switch off the public page, or suspend the account, without prior notice where the content is manifestly illegal or where a delay would cause harm. Where notice is reasonably possible, it will be given.
4b. Reporting content
Anyone can report content on a public page, whether or not they hold an account. Every public page carries a report link, and reports can also be sent to the address in the Impressum. A report should name the address of the page and say what is wrong with it.
Reports are reviewed and, where a report is well founded, the content is removed and the person who published it is informed of the decision and of the reasons for it. Where a report is rejected, the person who made it is informed on request. This is the notice and action mechanism under Article 16 of Regulation (EU) 2022/2065 (Digital Services Act).
5. Premium account and subscriptions
BOOKMAX.NET may offer PREMIUM subscriptions with additional storage, features or other benefits.
The applicable price, subscription period and principal features are displayed before you complete the purchase.
A PREMIUM subscription may automatically renew at the end of its selected term unless you cancel it before the renewal date. The renewal conditions are displayed during the purchase process.
You can cancel your subscription through the account settings. Cancellation normally prevents the next renewal; your PREMIUM access remains available until the end of the period already paid for, unless applicable law provides otherwise.
Payments are processed by a third-party payment provider. BOOKMAX.NET does not store your complete payment card details. The payment provider may process payment information in accordance with its own terms and privacy practices.
Except where otherwise required by applicable law, payments are non-refundable.
Nothing in this section excludes or restricts a consumer's statutory rights, including rights relating to withdrawal, termination, conformity of the digital service or reimbursement where applicable.
6. Right of withdrawal and consumer rights
If you are a consumer, you may have a statutory right of withdrawal from a distance contract.
The applicable withdrawal period and the conditions for exercising that right are provided to you during the purchase process and in the information provided to you before the contract is concluded.
Where the Service is provided immediately after purchase, any consent, acknowledgement or other steps required by applicable law concerning the commencement of the Service during the withdrawal period will be obtained separately where necessary.
Nothing in these Terms limits any mandatory consumer rights relating to withdrawal, conformity, remedies, termination, refunds or reimbursement.
7. Changes to the service
BOOKMAX.NET may make changes to the Service where reasonably necessary, including changes required for security, technical reasons, legal or regulatory requirements, compatibility, maintenance or improvements.
Where a change materially negatively affects a paid digital service and applicable law gives you a right to terminate the contract, we will provide the rights and notice required by law.
Minor changes that do not materially affect the Service may be made without individual notice.
BOOKMAX.NET may also discontinue individual features where this is reasonably necessary. Where applicable law requires notice, reimbursement or a right to terminate, those requirements will apply.
If BOOKMAX.NET permanently discontinues the Service as a whole, we will provide reasonable notice where practicable and where required by applicable law.
8. Termination and suspension
You may stop using your account at any time.
BOOKMAX.NET may suspend or terminate an account where reasonably necessary, including where:
- you materially breach these Terms;
- you use the Service unlawfully;
- your use creates a significant security risk;
- you interfere with the operation or security of the Service;
- you infringe the rights of BOOKMAX.NET or third parties; or
- a PREMIUM subscription remains unpaid after applicable payment procedures have been completed.
Where appropriate and reasonably possible, BOOKMAX.NET will give you an opportunity to remedy a breach before terminating your account.
Immediate suspension or termination may be necessary where this is required to protect the Service, other users or third parties, or where continued use would be unlawful or create a serious security risk.
Termination does not affect rights or obligations that arose before termination.
Where an account is terminated, BOOKMAX.NET may delete the account and its data after the applicable retention period, subject to legal obligations and the specific rules for inactive accounts in Section 9.
9. Inactive accounts
Accounts that are no longer used still have to be administered, and personal data should not be kept longer than it serves a purpose. For that reason BOOKMAX.NET deletes accounts that are no longer used.
We do not do this quietly: you are warned three times, by email, before anything is removed. The procedure is as follows:
- After eleven months without a single login, we send a first warning email to the address stored in your account. That email states the exact date on which the account will be deleted.
- Two weeks later we send a second warning email, and a third one shortly before the deletion date. All three name the same date.
- There is always at least one month between the first warning email and the deletion.
- If you log in at any time before that date, your account is taken out of the procedure and the period starts again from that login. You do not have to answer the email and you do not have to do anything else. Logging in is enough.
- Accounts with a running PREMIUM subscription are not deleted for inactivity.
- If you have ever paid for PREMIUM, your account is never deleted for inactivity - not even years after the subscription has expired.
- If all three warning emails come back as undeliverable, the deletion date stays exactly as it was - the undeliverable mail does not shorten any period. It only means that we have no way left of reaching you, so no further warning can be given. Keeping the email address in your account up to date is your responsibility.
On the deletion date the account is locked, not erased. For one month after that date it stays untouched: you cannot sign in, but nothing is gone yet. Write to us within that month and we put it back.
After that month the deletion is complete and it is final. It removes your bookmarks, folders, lists, contacts, notes, documents, feeds, tags and the files you have uploaded. There is no restore afterwards. We cannot give the data back to you, and we do not keep a copy for you.
Every warning email tells you what to do: log in before the date given, and nothing happens.
If you want your data as a file, log in and use the export function in your account settings. It gives you everything in one file, at any time and free of charge.
If you want to keep your data without using the Service regularly, either log in at least once a year, or export it before you stop using it.
This Section does not affect any mandatory statutory retention obligations or other rights that cannot legally be excluded.
10. Availability and technical limitations
BOOKMAX.NET aims to provide a reliable Service but cannot guarantee that the Service will always be available without interruption or error.
Temporary interruptions may occur, for example, because of maintenance, technical problems, security measures, Internet or hosting failures, or circumstances outside our reasonable control.
Where reasonably practicable, planned maintenance that materially affects the availability of a paid Service may be announced in advance.
Nothing in these Terms excludes any statutory rights you may have where the Service does not conform to the requirements imposed by applicable law.
11. Limitation of liability
BOOKMAX.NET is liable in accordance with applicable law.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
In particular, nothing in these Terms excludes or limits liability for death or personal injury caused by unlawful conduct, for intentional or grossly negligent conduct where such limitation is prohibited, or for other liability that cannot legally be excluded or limited.
To the extent legally permitted, BOOKMAX.NET is not responsible for indirect or consequential losses that were not reasonably foreseeable at the time the contract was concluded.
BOOKMAX.NET is not responsible for problems caused exclusively by circumstances outside its reasonable control, by the user's Internet connection or equipment, or by unlawful or improper use of the Service by the user, except where BOOKMAX.NET is legally responsible for the relevant loss.
You are responsible for maintaining your own copies of particularly important data. BOOKMAX.NET provides an export function that allows you to export your stored data free of charge.
Nothing in this section removes any mandatory consumer rights or statutory remedies.
12. Your use of the service
You agree to use BOOKMAX.NET in accordance with applicable law and these Terms.
You must not:
- use the Service for unlawful purposes;
- interfere with the operation or security of the Service;
- attempt to gain unauthorized access to accounts, systems or data;
- upload malicious software, viruses or other harmful code;
- use the Service to distribute spam or unauthorized bulk communications;
- impersonate another person or entity;
- infringe intellectual property, privacy or other rights of third parties; or
- deliberately impose an unreasonable or disproportionate load on BOOKMAX.NET infrastructure.
You must not use automated tools to copy or monitor BOOKMAX.NET pages or Service content where this would interfere with the Service or violate applicable law or the rights of BOOKMAX.NET.
BOOKMAX.NET may take reasonable measures, including restricting or suspending access, where necessary to address violations of these Terms, security risks or unlawful activity.
13. Age requirement
You must be at least 13 years old to use BOOKMAX.NET.
If applicable law in your country requires a higher minimum age for providing consent to the processing of personal data or entering into the relevant contract, that higher age requirement applies.
14. Copyright and intellectual property
BOOKMAX.NET and its software, design, trademarks, logos and other materials provided by BOOKMAX.NET are protected by applicable intellectual property laws.
You may use the Service and BOOKMAX.NET materials only as permitted by these Terms and applicable law.
You retain ownership of content that you store in your account, subject to any rights of third parties.
You grant BOOKMAX.NET only the limited rights necessary to host, store, transmit, display and technically process your content for the purpose of providing the Service.
15. Copyright infringement
If you believe that content available through BOOKMAX.NET infringes your copyright or other intellectual property rights, please contact us at mail@bookmax.net.
Please provide sufficient information to identify the allegedly infringing material and to allow us to investigate the complaint.
16. Third-party websites and links
BOOKMAX.NET allows you to store links to third-party websites.
BOOKMAX.NET does not control or generally review the content, availability or security of third-party websites linked from your bookmarks.
Your use of third-party websites is subject to the terms and privacy policies of those websites.
BOOKMAX.NET is not responsible for the content or operation of third-party websites except where applicable law provides otherwise.
17. System integrity and security
You must not use devices, software or routines intended to interfere with the proper operation of BOOKMAX.NET.
You must not attempt to circumvent technical restrictions, gain unauthorized access, probe or attack BOOKMAX.NET systems, or interfere with the security of the Service.
You must not use automated access methods to copy BOOKMAX.NET content or pages in a manner that violates these Terms or imposes an unreasonable load on the Service.
These restrictions do not prohibit activities that are permitted by applicable law.
18. Governing law and consumer rights
These Terms are governed by the laws of Austria, subject to any mandatory provisions of the law that apply to consumers in their country of residence.
If you are a consumer, the choice of Austrian law does not deprive you of mandatory consumer protection provisions that would otherwise apply to you.
Nothing in these Terms limits your right to bring proceedings before a court that has jurisdiction under applicable law.
Any statutory limitation or prescription periods remain unaffected by these Terms.
19. Severability
If any provision of these Terms is or becomes invalid, unlawful or unenforceable, the remaining provisions remain unaffected.
The invalid or unenforceable provision shall be replaced or interpreted to the extent necessary to achieve, as far as legally permissible, the purpose intended by the original provision.
